Definitions

NUTRINET refers to NutriNet Solutions cc, its owners, managers, employees, agents, associated, and representatives;

SERVICES refer to this website, including but not limited to general information, business information, product support, technical support, reviews, commentaries, downloadable files, communication facilities, articles, and how to's, and any other online services provided through this website;

USE refers to your downloading of files, viewing or printing of content, or deriving utility from the SERVICES in any way;

TOU (Terms of Use) refers to these terms and conditions;

(a) Changes to the TOU

NUTRINET reserves the right to change the TOU from time to time without notice to you. TOU, as available through the SERVICES, governs your USE of the SERVICES.

(b) Agreement

If you continue to USE the SERVICES, you acknowledge that you agree to the TOU. You may not continue to USE the SERVICES if you do not agree to the TOU.

(c) Use

Unless specified otherwise, the SERVICES are for your personal and non-commercial USE. The SERVICES are provided for enrichment and information purposes only.

(d) Viruses and malicious software

While NUTRINET will make every effort to prevent viruses or malcious software from entering the network through which it provides the SERVICES, NUTRINET is not responsible for any damages or losses you may suffer under conditions beyond the control of NUTRINET. NUTRINET strongly recommends that you install and regularly update antivirus, antispyware, and firewall software.

(e) Copyright

Unless specified otherwise, the SERVICES are the copyrighted work of NUTRINET. You may be granted permission to include parts of the SERVICES in a service of your own, provided that you indicate your USE of the SERVICES to NUTRINET, and comply with any requirements laid out in writing by NUTRINET. You may not otherwise copy any content obtained through the SERVICES.

You agree not to violate, harm, or treat in an unfair or unlawful manner the copyright of any third party in your USE of the SERVICES.

You may not copy, modify, redistribute, republish, transfer, or sell any content obtained through the SERVICES.

(f) Policy on Copyright Infringement

NUTRINET makes every effort to obtain permission from third party copyright owners before making parts of their work available through the SERVICE. This may however not always be possible. NUTRINET will respond expeditiously to claims of copyright infringement, and will take corrective action up to and including removing offending content.

(h) Trademarks

Elements of the SERVICES, including but not limited to the design and layout of this website, are protected by trade dress, trademark, unfair competition, and other laws, and may not be copied or imitated in whole or in part. No logo, graphic, sound, or image obtained through the SERVICES may be copied or retransmitted without express permission.

You agree not to violate, harm, or treat in an unfair or unlawful manner  any third party's trademark in your USE of the SERVICES.

All trademarks mentioned in the SERVICES are the trademarks of their respective legal owners. NUTRINET does not claim ownership of such trademarks.

(i) No unlawful or prohibited use

You may not USE the SERVICES for any purpose that is unlawful or prohibited by the TOU, or in any manner that constitutes a violation of national legislation. You may not USE the SERVICES in any manner that could damage, disable, overburden, or impair the NUTRINET server, or the network through which NUTRINET provides the SERVICES. You agree not to interfere with any other party's use and enjoyment of the SERVICES. You may not attempt to gain unauthorised access to any restricted SERVICES, or to any device connected to the NUTRINET server through hacking, cracking, brute forcing, or any other means.

(j) Communication facilities

The SERVICES may contain communication facilities, including but not limited to e-mail services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets and other message or communication facilities designed to help you communicate with NUTRINET or other parties. You agree to use communication facilities only to transmit messages and material that are proper, and when applicable, related to the particular communication facility. You will not:

• USE the communication facilities in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
• Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information.
• Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consent to do the same.
• USE any material or information, including images or photographs, which are made available through the SERVICES in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.
• Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.
• Advertise or offer to sell or buy any goods or services for any business purpose, unless such communication facilities specifically allow such messages.
• Download any file posted by another user of a communication facility that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner.
• Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
• Restrict or inhibit any other party from using and enjoying the communication facilities.
• Violate any code of conduct, or other guidelines which may be applicable for any particular communication facility.
• Harvest or otherwise collect information about others, including e-mail addresses.
• Violate any applicable laws or regulations.
• Create a false identity for the purpose of misleading others.
• USE, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the SERVICES, or usage information, or any portion thereof.

NUTRINET has no obligation to monitor the communication facilities. However, NUTRINET reserves the right to review materials posted by means of communication facilities, and to remove any materials in its sole discretion. NUTRINET reserves the right to terminate your access to any or all of the SERVICES at any time, without notice, for any reason whatsoever.

NUTRINET reserves the right to at all times disclose any information as deemed necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in its sole discretion. Always use caution when giving out any personally identifiable information about yourself or your children using any communication facilities. NUTRINET does not control or endorse the content, messages or information found in any communication facility and, therefore, NUTRINET specifically disclaims any liability with regard to the communication facilities and any actions resulting from your participation in any communication facilities. Managers and hosts are not NUTRINET spokespersons, and their views do not necessarily reflect those of NUTRINET.

Materials uploaded to the communication facilities may be subject to posted limitations on usage, reproduction and/or dissemination; you are responsible for adhering to such limitations if you download the materials.

(k) Links to third party websites

Linked content is not under the control of NUTRINET, and NUTRINET is not responsible for the contents of any linked website, or any changes or updates to such sites. NUTRINET is not responsible for webcasting or any other form of transmission received from any linked website. NUTRINET provides links to third party websites for your convenience, and the inclusion of any link does not imply endorsement of the applicable website, or its contents, or its view points.

(l) Unsolicited ideas submissions policy

NUTRINET does not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new products or services, new technologies, processes, materials, marketing plans, or new product names. Please do not submit any original creative artwork, samples, demos, or any other works. The sole purpose of this policy is to avoid potential misunderstandings and disputes when NUTRINET's products, services, or marketing strategies might seem similar to ideas submitted to NUTRINET. NUTRINET makes no assurances that original ideas will be treated as confidential or proprietary.

(m) Disclaimer

NUTRINET makes no representation about the suitability of the SERVICES for any purpose. The SERVICES are provided "as is" without any warranty of any kind. NUTRINET disclaim all warranties and conditions with regard to the SERVICES, including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement. In no event shall NUTRINET be liable for any special, indirect or consequential damages, or any damages resulting from loss of use, data or profits whatsoever, whether in action of contract, negligence, or tort, arising out of or in connection with the USE of the SERVICES.

The SERVICES could include technical inaccuracies or typographical errors. Changes are periodically made to the SERVICES. NUTRINET may make improvements or changes to the SERVICES.
